1. Heard learned counsel for the petitioner and learned APP for the State. No one appears on behalf of opposite party no.2 despite valid service of notice.
2. The petitioner apprehends his arrest in connection with Jandaha P.S. Case no.123 of 2024 registered under sections 341, 323, 354, 384, 504 and 34 of the Indian Penal Code and Sections 66C and 66D of the I.T. Act.
3. As per the prosecution case, the informant states that the petitioner had clicked some photographs of the informant's daughter and was making the same viral and he was even demanding Rs.20,000/- in the form of rangdari. She further stated that the petitioner was threatening to get her

4. Learned counsel for the petitioner submits at the outset that victim of this case is none other than the wife of the petitioner to whom he was legally wedded. As a matter of fact the petitioner had love affair with the daughter of the informant i.e. the alleged victim for the past two years and on 05.01.2024 both the petitioner and the victim solemnized marriage with each other at temple and the photograph of the same has been brought on record by way of Annexure-P/3 and receipt of the said temple duly signed by both the parties has also been annexed as Annexure-P/2 to the petition.
The present case was subsequently lodged against the petitioner since the said marriage was not approved by the family of his wife, however, the materials collected during course of investigation in the form of statements of some independent witnesses also indicate that marriage between the parties had been solemnized and they were also staying together as husband and wife. So far as allegation of making photographs viral on the social media is concerned, it has been submitted that the photographs which are said to be on the social media are the photographs of marriage of the petitioner with the informant's daughter and there is nothing objectionable about the same.
Patna High Court CR. MISC. No.74280 of 2024(8) dt.09-07-2025 3/3 submitted that even after marriage, there are several money transactions showing that the petitioner had given money, jewelry etc., to his wife who is the daughter of the informant. The petitioner has no criminal antecedent and undertakes to cooperate in the case/trial.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

In view of the aforesaid facts and circumstances of the case, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Jandaha P.S. Case no.123 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M, Vaishali at Hajipur, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023.
