====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 17-05-2023 Heard Mr. Rakesh Kumar No. 1, learned counsel appearing on behalf of the petitioner and Mr. Tarun Prasad Mandal, learned A.P.P. for the State.

The petitioner seeks bail, who is in custody since 30.09.2020, in connection with Raxaul P.S. Case No. 367 of 2020, dated 28.09.2020, registered under Sections 340(B), 34 of the Indian Penal Code and Charge-sheet was submitted under Section 302 of the Indian Penal Code.

This Court vide order dated 04.01.2023 directed the learned Sub-Divisional Judicial Magistrate, East Champaran, Motihari to furnish a report with respect to stage of trial, It has been informed vide Letter No. 203, dated 28.2.2023 by the Additional District & Sessions Judge- 19th, East Champaran, Motihari that out of 10 witnesses 9 have been examined.

Patna High Court CR. MISC. No.67995 of 2022(4) dt.17-05-2023 2/2 Considering the advance stage of the trial, I am not inclined to grant bail to the petitioner.

The Court below is directed to conclude the trial within a period of three weeks without fail.

In case, the witnesses do not appear on the date fixed by the Trial Court, the Superintendent of Police, East Champaran, must ensure for production of all the witnesses for expeditious disposal of the trial within the aforesaid period. (Purnendu Singh, J) pravinkumar/- U
