ANJANA MISHRA ORAL ORDER 17-05-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 10.08.2017 in connection with S.T. No.971 of 2017 arising out of Nathnagar P.S. Case No.413 of 2017 registered for the offence under Sections 302, 120B and 201 of the Indian Penal Code. Learned counsel for the petitioner submits that only on the basis of suspicion that the husband of the informant and one Arbind Mandal had illicit relationship with the younger sister of the informant i.e., Sanehlata Devi, the present petitioner, she in conspiracy with other co-accused persons has killed the husband of the informant. It is further submitted that save and except the aforementioned allegation levelled by own elder sister of the petitioner, there is no further material to

It is submitted that when the petitioner was taken into custody, she was made to give a self-confession and on the basis of the said self-confession, she has been languishing in jail. It is further submitted that no one has seen the deceased either going to the residence of the present petitioner nor is there any further material to implicate her in the conspiracy as has been alleged in the F.I.R. It is thus submitted that the petitioner on the basis of her own self confession cannot be prosecuted as the same has no evidentiary value.
Having heard learned counsel for the petitioner and after considering that the petitioner has been in custody for almost nine months and that she has no criminal antecedents, let the petitioner, above named, be released on bail on her furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd A.D.J., Bhagalpur or his successor court, in connection with S.T. No.971 of 2017 arising out of Nathnagar P.S. Case No.413 of 2017.
