The grievance of the petitioners in the present writ application is that the respondents have made pick and choose in the matter of sending the petitioners for in-service training and taking advantage of their own wrong, the respondents cannot deny trained scale to the petitioners.

Similar issue was considered by this Court in C.W.J.C. No. 7322 of 2017 and vide order dated 11.04.2018, the writ application was disposed of.

In view of the above, the present writ application is

Patna High Court CWJC No.19689 of 2019(2) dt.24-09-2019 2/2 disposed of with a direction to the respondents to workout the entitlement of the petitioners for grant of trained scale after three years from the date of their appointment or from 2003, whichever is later, as there is lapse on the part of the respondents in not sending the petitioners for in-service training earlier. The entire exercise must be completed by the respondents within a maximum period of four months from the date of receipt/production of a copy of this order. With the aforesaid, the writ application stands disposed of.
