2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 191(2), 191(3), 115(2), 118(1), 109(1), 352 and 351(1) of the BNS.
3. As per F.I.R., on the alleged date and time of occurrence, petitioners along with other accused person assaulted the informant with axe. Petitioner no.1 also assaulted on head of Harikishore Kumar with axe.
4. It is submitted on behalf of the petitioners that on account of land dispute marpeet took place. The present F.I.R. has been lodged after delay of three days and there is no
Patna High Court CR. MISC. No.69068 of 2025(2) dt.07-10-2025 2/2 plausible explanation for the same, which itself creates doubt on the entire prosecution case. Injury, allegedly, caused by these petitioners is simple in nature. Petitioners have got two criminal antecedents in which they are on bail.
5. Learned counsel for the State opposed the bail petition.
6. Considering the nature of injury and other circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Dhoraiya P.S. Case No. 147 of 2025, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023.
