JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 06-01-2023 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(a) and 30(d) of the Bihar Prohibition and Excise Act. 15 litres of country made liquor, 100 litres of Mahua pass and one cylinder from the place of occurrence. The petitioner and other co-accused persons are said to have fled away from the place of occurrence after seeing the police. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that there is no recovery from

Patna High Court CR. MISC. No.70449 of 2022(2) dt.06-01-2023 2/2 the conscious possession of the petitioner. It is also submitted that similarly situated co-accused person has already been enlarged on anticipatory bail by a co-ordinate Bench of this Court.

Learned APP for the State opposed the prayer for grant of anticipatory bail by submitting that petitioner is a member of the syndicate involved in manufacturing illicit liquor.

Taking into consideration the fact that petitioner is a members of the syndicate involved in manufacturing illicit liquor, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for grant of anticipatory bail to the petitioner is rejected in connection with Jagdishpur P.S. Case No.334 of 2022, pending in the court of learned Exclusive Special Excise Court-1st, Bhojpur at Arrah.
