JUSTICE ARUN KUMAR ORAL ORDER 15-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 8.1.2018, seeks bail in Ghosi PS Case No. 261 of 2017 registered under Sections 304(B), 201 and 34 of the IPC.

Learned Counsel for the petitioner submits that the petitioner's wife died of food poisoning, she was cremated in presence of her parents after giving information and later on this false case was lodged.

However, learned Counsel for the State submits that within two years of marriage she died in unnatural circumstances, there is allegation that the accused persons used to make demand of further dowry after marriage and the petitioner is husband. Having considered the aforesaid facts and circumstances, the prayer for bail of the petitioner is at present rejected. The trial court is directed to expedite the trial and preferably conclude the same within a period of one year and if not concluded the petitioner may renew his prayer for bail.
