Petitioner, already in custody, seeks bail in connection with Phulwaria PS Case No.173 of 2009, registered under Sections 328, 302 and 34 of the Indian Penal Code. It is contended that there is land dispute between the petitioner and the informant and on account of that, false implication was made. It is also not alleged that the petitioner had taken away the deceased so he returned back in drunken condition and died of taking spurious liquor, the case is still at the investigation stage for last nine years and similarly situated Krishna Yadav has been admitted to bail by a co-ordinate Bench of this Court vide Cr. Misc. No.30386 of 2016 on 17.10.2016. Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.30590 of 2018(2) dt.17-05-2018 2/2 circumstances, petitioner Brijlal Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-XIII, Gopalganj in connection with Phulwaria PS Case No.173 of 2009.
