The petitioner seeks regular bail in connection with Kahalgaon Shivnaranpur P.S. Case No. 867 of 2023 instituted for the offences punishable under Section 30(a) of the Bihar Prohibition & Excise Act.

It is alleged that total 100 liters of country made liquor was recovered from a co-accused.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that nothing was recovered from the conscious possession of the petitioner and petitioner is in judicial custody since 23.07.2023.

Patna High Court CR. MISC. No. 73237 of 2023(2) dt.22-11-2023 2/2 Learned APP for the State opposes the prayer for bail. Considering the facts and circumstances of the case and submission of learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise JudgeII, Bhagalpur in connection with Special Excise Case No. 3658 of 2023 arising out of Kahalgaon Shivnaranpur P.S. Case No. 867 of 2023.
