This application has been filed for cancellation of the bail granted to O.P.no.2, vide order dated 4.5.2017 passed in ABP No.430 of 2017 in connection with Simari P.S.Case No.24 of 2017 by the learned Sessions Judge, Darbhanga. Grounds for cancellation of bail are that the learned Sessions Judge, Darbhanga has wrongly come to a conclusion that nothing has been misappropriated and also not considered the antecedent of the petitioner while granting anticipatory bail to the petitioner.

Heard learned APP as well as the learned counsel for the O.P.no.2 and perused the impugned order, from which it

No.57151 of 2017(6) dt.18-02-2020 2/2 appears that the learned Sessions Judge has given reason for grant of the anticipatory bail and also relied on some documents and thereafter passed order. There is no allegation of misuse of the privilege of the bail or tampering with the evidence or absconding of the petitioner.

In view of the above, I find no merit in this application.

Accordingly, this application is dismissed.
