The petitioner seeks bail in connection with Amarpur P.S. Case No. 614 of 2017 for the offences punishable under Sections 307/34/302/34 of the Indian Penal Code and Section 27 of the Arms Act.
The allegation is regarding causing firearm injury on the abdomen of the informant by the co-accused namely Kailash Yadav. As far as the petitioner is concerned, it has been alleged that the petitioner and other co-accused persons had surrounded the deceased.
The leaned counsel for the petitioner submits that the petitioner is innocent, is having a clean antecedent and he is in
Patna High Court Cr.Misc. No.30341 of 2018 (2) dt.22-05-2018 2/2 custody since 20.02.2018. It is further submitted that similarly situated co-accused person has already been granted bail by this Court by order dated 11.04.2018 passed in Crl. Misc. No. 19614 of 2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka in connection with Amarpur P.S. Case No. 614 of 2017.
