Petitioner is in custody in connection with Nawada (Bundelkhand) P.S. Case No. 239 of 2018 for the offenses under sections 30(a) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that the petitioner is driver of the vehicle. He is neither owner of the vehicle nor owner of the liquor seized by the police. He also submits that petitioner was not aware of the fact that the country made liquor was loaded in the vehicle.

Considering the fact that petitioner has no criminal antecedent and he has remained in custody for nearly one and half months and the fact that petitioner is not owner of the

No.32189 of 2018(2) dt.05-06-2018 2/2 vehicle, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II cum Special Judge-Excise Act, Nawada, in connection with Nawada town (Bundelkhand) P.S. Case No. 239 of 2018.
