JUSTICE ARUN KUMAR ORAL ORDER 29-01-2018 Heard learned Counsel for the petitioners and the State as also the learned Counsel appearing on behalf of the Informant. Petitioner, already in custody, seeks bail in Madanpur PS Case No. 125 of 2017 registered under Sections 302/34 of the IPC. The allegation in brief is that only suspicion is raised against the accused persons including the petitioners that they killed son of the informant as he had gone to sleep on the roof of the house and in the next morning his dead body was found lying by the side of the house.
Learned Counsel for the petitioners submits that except suspicion raised by the informant there is no other material, only material which transpired during investigation is that they had called for the deceased for dinner in the night, however both the petitioners and the deceased are co-villagers and there is no such motive or ill will for committing murder. Similarly situated three co-accused persons have been admitted to bail by a coordinate Bench of this Court.
Having considered the said facts and circumstances, the
Patna High Court Cr.Misc. No.56286 of 2017 (3) dt.29-01-2018 petitioners, namely, Jai Prakash @ Monu, Tun-tun Singh @ Pranav Singh and Sushil Kumar @ Bhura are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) by each one of them with two sureties of the like amount each to the satisfaction of CJM Aurangabad in connection with Madanpur PS Case No. 125 of 2017.
