JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 05-09-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Special Case No. 27 of 2014 arising out of Economic Offence P.S.Case No. 20 of 2014 registered under Sections 414, 420, 467, 468, 471, 472 & 34 of the Indian Penal Code and 20 (B)(1), 23 & 29 of the N.D.P.S. Act.

The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 22.09.2014 passed in Cr.Misc. 35064 of 2014.

It is submitted by the learned counsel for the petitioner that by now the petitioner has remained in custody for over four years and there is no likelihood of completion of the trial

Patna High Court Cr.Misc. No.29983 of 2018 (2) dt.05-09-2018 2/2 in near future. He submitted that similarly circumstanced coaccused Suresh Kumar @ Suresh Rai has already been granted bail by this Court vide order dated 29.11.2217 passed in Cr. Misc. No. 43283 of 2017.

Mr. Vishwanath Prasad Sinha, learned Senior Advocate appearing for the Economic Offences Unit submitted that by now out of 13 witnesses 7 have already been examined. However, he admits that the case of the petitioner stands on identical footing to that of Suresh Kumar, who has already been granted pre-arrest bail by this Court.

Having regard to the submissions made above, for the reasons assigned in the order dated 29.11.2017 passed in Cr. Misc. 43283 of 2017, the application is allowed. The petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-I, Patna, in connection with Special Case No. 27 of 2014 arising out of Economic Offence P.S.Case No. 20 of 2014.
