JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-06-2018 Mr. Sanjeev Kumar (AOR No.00249), learned counsel for the petitioner submits that inadvertently second anticipatory bail application has been filed on behalf of the petitioner Lalan Yadav in connection with Wazirganj P.S. Case No. 398 of 2015.

Though earlier an application was preferred with a prayer for anticipatory bail which was disposed of vide order dated 07.01.2016, passed in Criminal Miscellaneous No. 332 of 2016 with a direction to the petitioner to surrender before the learned Court below within a period of six weeks to seek regular bail, but since learned counsel for the petitioner was not properly instructed, hence, the second anticipatory bail application was filed. The application has been affidavited by Mantu Kumar, cousin of the petitioner.

Permission is accorded.

Accordingly, the application is dismissed as withdrawn.

However, it is expected from learned counsel for the petitioner to be careful in future.
