The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 384 and 385 of the Indian Penal Code.
The prosecution case got initiated on the basis of written report dated 06.11.2017 submitted by Ramesh Kumar to the O.P. In-charge, Chero Police Station to the effect that the informant runs a bus, from Bakhtiarpur to Bihar and on 04.11.2017 at 2.15 P.M., while he reached near Kharuara turning, the petitioner stopped the bus of the informant and demanded Rs.200/- as extortion, whereupon, the conductor of the bus, Chai Kumar @ Mithilesh Kumar gave Rs.100/- as extortion to the petitioner. It is submitted by learned counsel for the petitioner that in
Patna High Court Cr.Misc. No.30708 of 2018(2) dt.18-05-2018 2/2 the background of land dispute the accusation has been levelled. A statement has been made in paragraph no.3 of the petition that the petitioner no.1 is accused in one other case, apart from the present case, wherein, he has been acquitted, whereas, petitioner no.2 is accused in one other case, wherein, he is on bail. It is submitted by learned APP for the State that there is specific accusation of demanding extortion against the petitioner.
Considering the accusation levelled in the background of land dispute, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Nalanda at Biharsharif, in connection with Harnaut (Chero) P.S. Case No.354 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
