The petitioner seeks bail in connection with Harsidhi P.S. Case No.482 of 2023 registered for the offence under Sections 341, 323, 302 and 504/34 of the Indian Penal Code.

The allegation against the petitioner is to have assaulted the informant and his family members by means of iron rod, lathi and farsa along with other co-accused persons. 4.

Learned counsel appearing on behalf of the petitioner submitted that petitioner has falsely been implicated in the present case. He further submitted that the allegation against the petitioner is general and omnibus in nature and he is

Patna High Court CR. MISC. No.75658 of 2023(2) dt.01-12-2023 2/2 in custody since 30.07.2023. It is further submitted that similarly situated co-accused persons have already been granted bail by different co-ordinate Bench of this Court vide order dated 18.10.2023 passed in Cr. Misc. No.67931 of 2023 and order dated 09.11.2023 passed in Cr. Misc. No.72149 of 2023. 5.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and similarly situated co-accused persons have already been granted bail by co-ordinate Bench of this Court, let the petitioner, above named, is directed to be released on bail in connection with Harsidhi P.S. Case No.482 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Motihari, East Champaran.
