2. In the present case, the petitioner seeks bail in connection with Manuapul P.S. Case No. 63 of 2024 registered for the alleged offences under Section 379 of the Indian Penal Code.
3. As per prosecution case, the informant, who has been working in Bharat Finance, Bettiah as field staff, had been returning after making collection of money from the customers, due to loss of balance of motorcycle he fell down. Later on, he found that from the dicky of the motorcycle Rs.22,835/- and tab of sumsang company were stolen apart from other documents. The name of the petitioner sprang up during investigation for
Patna High Court CR. MISC. No.69338 of 2025(2) dt.25-09-2025 2/3 being involved in the said case.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner was apprehended in Harsidhi P.S. Case No. 378 of 2024 on the basis of confessional statement of coaccused Appu Kumar Yadav and thereafter, he has been made accused in altogether 18 cases since the petitioner had hot exchange of words with the investigating officer of that case. There is no other material to show the complicity of the petitioner in the theft and nothing incriminating has been recovered from the person or possession of the petitioner. The petitioner is in custody since 15.05.2025 and charge sheet has been submitted.
5. Learned APP opposes the submission made on behalf of the petitioner.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the fact that no recovery has been shown from the petitioner and also considering the period of custody of the petitioner and submission of charge sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount

No.69338 of 2025(2) dt.25-09-2025 3/3 each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran/concerned Court in connection with Manuapul P.S. Case No. 63 of 2024, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions :
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below. (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
