JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-12-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Sirdala P.S. Case No. 168 of 2017 registered under Sections 304(B) and 201/34 of the Indian Penal Code.

The accusation is of torturing the daughter of informant by her husband and in-laws due to non-fulfillment of demand of dowry and putting her in fire. The daughter of the informant died in course of treatment after one month of occurrence at Magadh Medical College, Gaya.

Learned counsel for the petitioners submits that petitioners are father-in-law and sister-in-law (Gotni) of the

Patna High Court Cr.Misc. No.56686 of 2017 (2) dt.07-12-2017 deceased, daughter of the informant, and they have falsely been implicated in this case. In fact, deceased, daughter of the informant, sustained burn injury in the night of 06.06.2017 and she was rushed to Magadh Medical College, Gaya, for treatment, where he died on 05.07.2017 in course of treatment, but with ulterior motive the informant has lodged the present case on 13.07.2017 after one month of occurrence.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Nawada, in connection with Sirdala P.S. Case No. 168 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
