The petitioner seeks bail in a case registered for the offence punishable under Section 394 of the Indian Penal Code. Three unknown miscreants are said to have looted Hiwa Vehicle of the informant who was driving the same and mobiles, cash of Rs.11,000/- and golden locket of the informant assaulting the khalasi of the same.
It is submitted by learned counsel for the petitioner that the petitioner is quite innocent. He has committed no offence. He has been falsely implicated in the case at the instance of his enemies. No incriminating article has been recovered from the conscious physical possession of the petitioner. He was not put on T.I.P. There is nothing in the record indicating the complicity of
Patna High Court Cr.Misc. No.31222 of 2018 (2) dt.21-05-2018 2/2 the petitioner in the occurrence barring his confessional statement which has no evidentiary value in the eye of law. He has been languishing in custody since 14.11.2016.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jehanabad in connection with Ghosi P.S.
