The petitioner seeks bail in connection with Paraiya Police Station Case No. 89 of 2017 registered for the offence under section 7 of the Essential Commodities Act. The above case was registered on the basis of written report of Circle Officer-cum-Block Supply Officer, Paraiya, Gaya against as many as 09 PDS dealers on the allegation that they were engaged in black marketing the commodities.

It appears that similarly situated co-accuseds Ramanand Sharma @ Ramanan Sharma and Rajesh Kumar have been granted anticipatory bail by different coordinate Benches of this Court in Cr. Misc. Nos. 47213 and 51850 of 2017. The third

Patna High Court Cr.Misc. No.56752 of 2017 (2) dt.13-12-2017 2/2 co-accused Kailash Ram has also been allowed regular bail by one of the coordinate Bench of this Court in Cr. Misc. No. 58606 of 2017. It has been submitted that the petitioner having clean antecedent is in custody since 10.10.2017 and his case stands on similar footing to the cases of co-accuseds who have been allowed bail in the above cases and so he also deserves bail. Considering the fact that the case of this petitioner stands on similar footing to the cases of co-accuseds who have been allowed bail in the above cases, the prayer for bail of the petitioner is allowed and he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Paraiya Police Station Case No. 89 of 2017.
