The petitioner seeks bail in Mahakar P.S. Case No. 92 of 2016 registered under Sections 406, 419 and 420 of the Indian Penal Code.
Manager of Madhya Bihar Gramin Bank, Branch Kurwa, namely, Sidheshwar Das with the help of the mediator got opened 26 fake accounts in his bank and sanctioning the loan in the name of the aforesaid fake account holders defalcated the same.
It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in the case. He happens to be mere introducer and he had simply introduced some of the account
Patna High Court Cr.Misc. No.31206 of 2018 (2) dt.21-05-2018 2/2 holders to the Manager. He does not happen to be employee of the bank and has no concern with any transaction made in the aforesaid account by its employee including the Branch Manager. The then Branch Manager, namely, Sidheshwar Das has been exempted in the departmental proceeding filed against him. The petitioner has been languishing in custody since 07.02.2018. Branch Manger of aforesaid bank namely Sidheshwar Das has been enlarged on bail by a co-ordinate bench of this court vide order dated 21.09.2017 passed in Cr. Misc. No. 29900 of 2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Mahakar P.S. Case No. 92 of 2016.
