JUSTICE ASHUTOSH KUMAR ORAL ORDER 01-07-2020 A prayer has been made for modification of the order dated 13.08.2019 passed in Cr. Appeal (SJ) No. 1547 of 2019, whereby the appellant was directed to be enlarged on provisional bail in the event of his arrest or surrender before the court below within a period of four weeks from the date of passing of the order.

It has been submitted on behalf of the petitioner that he is a handicapped person and because of his illness, he could not surrender before the court below within the stipulated time.

Patna High Court CR. MISC. No.67662 of 2019(2) dt.01-07-2020 2/2 Now that he has recovered, he wishes to take advantage of the order which is sought to be modified. For the reasons stated in the application, the order dated 13.08.2019 is modified to the extent that if the petitioner surrenders before the court below within a period of six weeks from today, he shall be released on provisional bail, but subject to the terms and conditions which have been imposed in the order dated 13.08.2019.

The modification application stands allowed.
