Petitioner, already in custody since 1.12.2017, seeks bail in Sahar PS Case No. 105 of 2017 registered under Section 379 of the IPC.

It is submitted that the FIR is against unknown, neither the tractor was recovered from his possession nor any incriminating material, besides confessional statement of the petitioner there is no other material and he is in custody since 1.12.2017. Having considered the said facts and circumstances, the petitioner, namely, Mritunjay Kumar Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM X, Bhojpur Ara in connection with Sahar PS Case No. 105 of 2017.
