JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 This application, for grant of anticipatory bail, arises out of University P.S. Case No. 06 of 2014, disclosing offences under Sections 241, 323, 353 and 224 of the Indian Penal Code. Petitioner is named in the F.I.R. and as per F.I.R. that police raided the hostel of the petitioner and arrested him on the suspicion of being a naxalite, however, he managed to flee away with the help of his associates.

Submission of learned counsel for the petitioner is that with respect to the same occurrence, Superintendent of Hostel has also lodged a case against the police that they have forcibly taken away the petitioner and though the case is of the year 2014 but no step was taken by the police earlier. Heard learned A.P.P. also.

No.62159 of 2019(2) dt.15-10-2019 2/2 Having heard both sides, considering the facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the basis of materials available on record, if possible on same day, without being prejudiced by this order.
