2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 307, 354, 379,504 and other ancillary sections of the Indian Penal Code.

3. As per the prosecution case, on the alleged date and time of the occurrence, all the FIR named accused persons including these petitioners came to the house of the informant. Accused persons abused, assaulted the informant and his family members by means of lathi, danda, iron rod and also damaged household items. They took away cash and ornaments from the house of the informant. Petitioner no.1 assaulted one Udal

Patna High Court CR. MISC. No.78683 of 2023(3) dt.19-03-2024 2/2 Kumar on his head with Garasa. He tried to outrage modesty of the wife of the informant.

4. It is submitted on behalf of the petitioners that injury caused by petitioner no.1 has been found to be simple in nature. Learned counsel submits that due to land dispute, simple marpit took place in which both sides sustained injuries. There is case and counter case.

5. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VIII, Gaya in Konch Police Station Case No. 197 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
