2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 394, 411 of the Indian Penal Code.

3. As per prosecution case, four miscreants are said to have overtaken the vehicle of the informant and on pistol point, they snatched cash of Rs. 20,000/- along with key of the informant's vehicle and fled away. On the basis of GPS location fixed in the pickup, police chased and arrested one of the miscreants.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in the FIR. His name was transpired in

Patna High Court CR. MISC. No.72157 of 2023(3) dt.08-11-2023 2/2 this case on the basis of confessional statement of co-accused Ram Pravesh Ray who was arrested by police after chase. Nothing was recovered from conscious possession of this petitioner and looted vehicle was seized from possession of apprehended co-accused Ram Pravesh Ray. The petitioner has got no criminal antecedent and he is languishing in judicial custody since 12.8.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sarai P.S. Case No. 119 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-16, Vaishali at Hajipur.
