The petitioner seeks regular bail in connection with Sabour P.S. Case No. 104/2018 for the offences punishable under Section 30(A) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 167.400 liters of foreign liquor from a pick up van.
The learned counsel for the petitioner submits that neither the petitioner is owner of the said vehicle nor any recovery has made from conscious possession of the petitioner. It is further submitted that the petitioner is a driver of the said vehicle. It is further submitted that the petitioner has a clean antecedent and is languishing in custody since 08.04.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail
Patna High Court Cr.Misc. No.32977 of 2018 (2) dt.31-05-2018 2/2 on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. District & Sessions-Judge-cum-Excise, Bhagalpur in connection with Sabour P.S. Case No. 104/2018.
