Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code as well as Sections 16, 17, 18, 19, 20, 21 and 22 of the UPA Act.
This is the second attempt of the petitioner for grant of bail. Petitioner is in custody since 09.06.2017. Submission is that co-accused Ramesh Marandi, having similar allegation, has already been allowed bail by this Court vide order dated 05.03.2018 passed in Cr. Misc. No. 49583 of 2017 (Annexure-3) considering his period of custody of one year as well as no criminal antecedent and pendency of the trial. Only distinguishable factor in the matter of the
Patna High Court Cr.Misc. No.36528 of 2018 (2) dt.04-07-2018 2/2 petitioner is that the petitioner has got a criminal antecedent otherwise also he is in custody since 09.06.2017. Considering the aforesaid fact, especially, nonprogress of the trial, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chakai Police Station Case No. 57 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
