JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 13-06-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner, in the present case, is seeking regular bail in connection with Chakai P.S. Case No. 17 of 2015, registered for offences alleged under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that in the First Information Report the specific allegation of firing is against the co-accused Bal Mukund Pandey. So far as this petitioner is concerned, there is no allegation of assault against him, he is said to be one of the persons who had assembled and surrounded the informant.

Learned APP for the State is present and submits that this

Considering the facts and circumstances of the case whereunder it appears that the specific allegation of firing is against the co-accused Bal Mukund Pandey and this petitioner is only said to be a member of the mob, the petitioner having no criminal antecedent, I am inclined to grant regular bail to the petitioner. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Jamui in connection with Chakai P.S.
