The petitioner is apprehending his arrest in a case in connection with Chhapra Muffasil PS Case No. 533 of 2023 dated 12.07.2023, registered for the offences punishable under Sections 341, 323, 353, 332 and 504/34 of the Indian Penal Code.

As per the prosecution case, the informant along with other police personnel arrested the wanted accused of Chhapra Muffasil PS Case No. 338 of 2016, namely Pramod Kumar, but the petitioner, who is the son of the arrested person, along with his brother tried to get free the arrested accused. It is further alleged that they abused the police party and assaulted them with fists and slaps. The petitioner managed to flee from the place of occurrence.

Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.76504 of 2023(2) dt.18-12-2023 2/2 that the petitioner is quite innocent and had not committed any offence and has been falsely implicated in the present case as there is no independent witness proving the allegation of assault and the allegations are general and omnibus in nature. It is further submitted that the petitioner has fair and clean antecedent.

Learned APP for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances as well as the nature of allegation against the petitioner, let the petitioner named-above, in the event of his arrest / surrender within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran in connection with Chhapra Muffasil PS Case No. 533 of 2023, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This application stands allowed.
