This is the second attempt on behalf of the petitioner for grant of regular bail in connection with Shahpur P.S. Case No.787 of 2023 registered for the offence under section 302/34 of the Indian Penal Code and under section 27 of the Arms Act. Earlier, the bail application of the petitioner has been rejected by this Court vide order dated 14.03.2024 passed in Criminal Miscellaneous No.18070 of 2024.

As per the prosecution case, on 24.12.2023, in the morning, the informant's father received a call on his mobile and the caller wanted to meet him and was trying to know his current address for the last four months. Subsequently, the same caller called him from a different mobile number and

Accordingly, the informant's father meet him at Dibra More and when the informant's father was returning back, he was shot dead. It is further alleged that a case was going on between the informant's father and the co-accused Ranjeet Kumar, Kusum Devi and Ajay Singh, in which his father was acquitted by the Court, due to which, the aforesaid persons committed murder of the informant's father. 4.

The petitioner is in custody since 01.01.2024.

Learned counsel for the petitioner has produced a copy of the order dated 28.03.2025 passed by a coordinate Bench of this Court in Criminal Miscellaneous No.51820 of 2024, by which similarly situated co-accused Harsh @ Harsh Raj @ Sunny Kumar has been granted bail. 6.

Considering the fact that similarly situated co-accused has been granted bail by this Court, this bail application is also allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Danapur, in connection with Shahpur P.S. Case No.787 of 2023, subject to

Patna High Court CR. MISC. No.73178 of 2024(6) dt.11-04-2025 3/3 the condition that he will cooperate in the trial and will appear personally or through his advocate on the dates fixed in the trial. 8.

This is also subject to the condition that the petitioner shall mark his attendance in Shahpur Police Station, District- Patna on every Sunday of the month. Any default in appearance at the Police Station will result in cancellation of bail bonds of the petitioner.
