2. Learned counsel for the petitioner seeks permission to withdraw this application as against the petitioner no.1, as he has been arrested by the police during the pendency of the bail application.

3. Permission is granted.

4. Accordingly, this application as against the petitioner no.1 is dismissed as withdrawn.

5. Now, this application is being heard with regard to the

Patna High Court CR. MISC. No.81677 of 2023(2) dt.04-01-2024 2/2 petitioner nos.2, 3 and 4 only.

Learned counsel for the petitioner seeks permission to withdraw this application as against the petitioner nos.2 to 4 also, as they have been granted benefit of Section 41A of the Cr.PC and till date charge-sheet has not been submitted, therefore anticipatory bail is not maintainable.

7. Permission is granted.

8. Accordingly, this application as against the petitioner nos.2 to 4 is dismissed as withdrawn.

9. However, the petitioner nos.2 to 4 are at liberty to renew their bail application when the charge-sheet is submitted by the police.
