The petitioner seeks regular bail in connection with Fatuha P.S. Case No. 185/2018 for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 25 liters of country made liquor from a motorcycle.

The learned counsel for the petitioner submits that the petitioner is innocent and, in fact, no recovery has been made from the conscious possession of the petitioner inasmuch as the said motorcycle from where the country made liquor has been recovered, does not belong to the petitioner. The petitioner is stated to be in custody since 31.3.2018 and he has a clean antecedent.
