2. The petitioner apprehends his arrest in connection with Paroo P.S. Case No. 431 of 2019, registered for the offences punishable under Sections 304(B), 201/34 of the Indian Penal Code.
3. As per FIR, the petitioner is husband of the deceased. His marriage was solemnized with the deceased five years prior to lodging of the FIR. On 20.10.2019, the informant came to know that the petitioner and his family members, after committing dowry death of her daughter, had concealed her dead body. It has also been alleged that at the occasion of marriage, the accused persons demanded Rs. 60,000/- as dowry
Patna High Court CR. MISC. No.72267 of 2023(2) dt.08-11-2023 2/2 but the informant afforded to pay only Rs. 40,000/-.
4. The learned counsel for the petitioner has submitted that though petitioner is husband of the deceased, but he has falsely been implicated in this case. The mother-in-law and father-in-law of the deceased, on similar ground, have been granted bail by a coordinate Bench of this Court.
5. On the other hand, the learned APP for the State has opposed the prayer for bail and submitted that there is specific allegation against the petitioner that he had killed his wife. A black spot on the cheek, below the chest and above the abdomen of the deceased were found which shows that she was beaten before her death.
6. In my view, the petitioner does not deserve the privileges for bail, which is hereby rejected. (Nawneet Kumar Pandey, J) Kundan/- U T
