Petitioners apprehend their arrest in connection with Bidupur P.S. Case No.73 of 2022, registered for the offences punishable under Sections 399, 402 and 414 of the Indian Penal Code.

Prosecution case, in brief, is that police got information on 15.02.2022 that some miscreants are planning for committing cognizable offence near Bhairopur Hanuman Temple. The police raided the place and apprehended two coaccused persons. The police recovered arms and ammunition besides a Pulsar motorcycle from the apprehend accused persons. The apprehended accused persons disclosed the name of the petitioners and other co-accused persons that they fled

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. The petitioners have got no criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted that names of the petitioners surfaced in the case in the confessional statement of the apprehended accused. Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioners. Taking into consideration the nature of offence, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the prayer for grant of anticipatory bail to the petitioners is hereby rejected.
