ANJANA MISHRA ORAL ORDER 29-06-2018 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioner nos. 1 and 3 are in custody since 08.03.2018 and petitioner no. 2 is in custody since 26.03.2018 in connection with G.R. No. 435 of 2018, arising out of Samastipur Mufassil P.S. Case No. 126 of 2018 registered for the offence under Sections 302, 201 and 120(B)/34 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners have been roped in connection with the present case merely on the basis of suspicion and there is no eye witness to the

Patna High Court Cr.Misc. No.33123 of 2018 (4) dt.29-06-2018 2/2 alleged occurrence. It is further submitted that the petitioners were roped in the present case because on two previous dates there had been some differences between the informant and these petitioners.

Learned counsel appearing on behalf of the State after perusal of the case diary submits that save and except the suspicion raised against the petitioners there is no other material in the case diary to implicate the present petitioners. The petitioners are also having no criminal antecedent.

Having taken into consideration all facts and circumstances of the case, let the petitioners, above named, be released on bail on their furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 5th, Samastipur, in connection with G.R. No. 435 of 2018, arising out of Samastipur Mufassil P.S. Case No. 126 of 2018.
