The petitioner seeks pre-arrest bail in connection with G.R.P.S. Kishanganj P.S. Case No.28 of 2016 registered under Section 379 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that a mobile phone was purchased by Md. Jiyaur Rahman, cousin brother of the petitioner and without knowing the fact that the same is a stolen property, at his request he gave her sim for use, which was being used by him. Hence, the police has suspected the hand of the petitioner also in commission of the offence punishable under Section 379 of the Indian Penal Code.
