JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-04-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 379/354/506 and other ancillary sections of the Indian Penal Code.

Petitioner is said to have assaulted on the head of the informant with lathi causing him injuries. It is further alleged that petitioner took away gold ear ring.

Learned counsel for the petitioner submits that in fact some altercation took place between the parties during which informant fell down on the Khuta nearby the Naad in front of the house and sustained injury. Petitioner has got no criminal antecedent.

Considering the aforesaid facts of the case, prayer for

Patna High Court CR. MISC. No.67398 of 2022(2) dt.04-04-2023 2/2 bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV, Gaya in Khizersarai Police Station Case No. 26 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
