The petitioner, already in custody, seeks bail in connection with Kudhani P.S.Case No. 17 of 2018 registered under Sections 307,356, 394 and 414/34 of the Indian penal Code.

Learned counsel for the petitioner submits that both, informant and petitioner, are neighbouring villagers and known to each other and police has not submitted charge sheet under Section 392 of I.P.C. rather submitted charge sheet under Section 379 of I.P.C. and petitioner has been falsely implicate because of dispute with the informant and injury on his person is simple in nature and has only one criminal antecedent of Excise Act.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Raushan Kumar, is directed to be

Patna High Court Cr.Misc. No.33523 of 2018(3) dt.29-06-2018 2/2 released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM-III(W), Muzaffarpur in connection with Kudhani P.S. Case No. 17 of 2018.
