2. The petitioner seeks bail in connection with S. Tr. No. 419 of 2024, arising out of GRP Bakhtiyarpur (Fatuha) P.S. Case No. 168 of 2023 instituted for the offences under Sections 302, 120B, 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. The prosecution case, in short, is that, the accused persons including the petitioners fired upon the informant's brother due to which he died on the spot.
4. The petitioner has renewed his prayer for grant of regular bail which was earlier rejected by this Court vide order
Patna High Court CR. MISC. No.67831 of 2025(2) dt.17-09-2025 2/3 dated 19.03.2025 passed in Cr. Misc. No. 77274 of 2024.
5. Learned counsel for the petitioner submits that the petitioner is in custody since 07.02.2024. He further submits that the charge has been framed on 26.06.2024 and, thereafter, one witness namely Jugal Prasad, who is the brother-in-law of the deceased, has been examined on behalf of the prosecution on 17.04.2025 but, he has been declared hostile and, thereafter, no witness has been examined in this case. He further submits that there is no significant progress in trial and, thus, there is no likelihood of conclusion of the trial in near future.
6. Having heard learned counsel for the parties and taking into account the period of custody of the petitioner as also there being no significant progress in the trial, this Court is inclined to grant bail to the petitioner.
7. Accordingly, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with S. Tr. No. 419 of 2024, arising out of GRP Bakhtiyarpur (Fatuha) P.S. Case No. 168 of 2023, subject to the following conditions;
(i) One of the bailor(s) shall be the own/close family

(ii) The petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and in the event of failure on two consecutive dates without sufficient reasons, his bail bond shall be liable to be cancelled by the court below.
