====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER -------------- 07-12-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Giriyak (Katrisarai) P.S. Case No.299 of 2017 registered under Sections 419, 420, 467, 468 and 471 of the Indian Penal Code besides Section 66 of the I.T. Act.

The accusation is that on receiving secret information about committing cheating to the customers of the Measurement Company by obtaining their SIM numbers and Bank Accounts by Upendra Chaurasiya and Shailendra Chaurasiya (petitioner no.1) on giving the allurement of wining the prize, the informant being the Officer Incharge

Patna High Court Cr.Misc. No.56652 of 2017 (2) dt.07-12-2017 2/2 of Katrisarai Police Station alongwith other police officials raided the house of Upendra Chaurasiya. In course of raid, while two persons succeeded to flee away but two persons were apprehended, who disclosed their name as Upendra Chaurasiya and Akhilesh Paswan and Upendra Paswan also disclosed the name of two persons, who succeeded to flee away, as Shailendra Chaurasiya (petitioner no.1) and Pawan Kumar (petitioner no.2). On search, four mobile sets and list of customers of the Measurement Company with their mobile numbers were also recovered.

Learned counsel for the petitioners submits that, in fact, the petitioners were not present at the house at the time of the alleged raid. The petitioners have no criminal antecedents. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Giriyak (Katrisarai) P.S. Case No.299 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
