2. The petitioner seeks bail in connection with Ajamnagar P.S. Case No. 248 of 2024 registered for the offence punishable under Sections 8(c) and 21(b) of the NDPS Act.

3. As per the prosecution case, 5.960 grams of smack has been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is in jail since 15.07.2024 having clean antecedent.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.72932 of 2024(3) dt.20-12-2024 2/2 of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Katihar/concerned Court in connection with Ajamnagar P.S. Case No. 248 of 2024.

7. This is subject to condition that the petitioner will also mark attendance in Azamnagar Police Station, DistrictKatihar on the first and third Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner.

8. This is also subject to condition that at the time of accepting bail bonds of the petitioner, the Court below will verify the criminal antecedent of the petitioner. If it is found that the petitioner has criminal antecedent, the Court below shall not accept the bail bonds of the petitioner and if it is found that the petitioner has clean antecedent, his bail bonds shall be accepted by the Court below.

9. This application stands allowed.
