The petitioner seeks bail in a case registered under Sections 397, 412, 413, 120(B) 379 of the Indian Penal Code. Allegation is that five unknown persons entered in the shop of the informant having pistol in their hands and on the point of pistol looted away gold ornaments of about 1 kg worth Rs.30 lakh and also took away cash Rs.1.5 lakh. It has been submitted on behalf of the petitioner that the petitioner is in custody since 4.2.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional
Patna High Court CR. MISC. No.63642 of 2019(2) dt.22-10-2019 2/2 statement of co-accused. There is no recovery of any incriminating article from the petitioner. The petitioner has not been put on T.I.P.
On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town P.S. case No.376 of 2018.
