The petitioner has prayed for bail in a case registered for the offence punishable under section 392 of the Indian Penal Code and section 25(1-b)a/26 of the Arms Act. As per allegation in the FIR, while the informant was returning to his house, four miscreants encircled him and on pistol point the snatched his Rs. 600/-. On raising alarm by the informant, two of them were apprehended and they disclosed the name of the petitioner as of his associates. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner was not present at the place of occurrence. Petitioner has not

Apprehended accused namely, Aman Kumar and Rohan Kumar has disclosed the name fo the petitioner before the police, which has got no evidentiary value in the eye of law. Petitioner is languishing in judicial custody since 28.07.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJMI, Patna in connection with Jakkanpur P.S. Case No. 232 of 2021.
