JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-04-2023 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Baniyapur P.S. Case No. 430 of 2021 registered for the offences punishable under Sections 30(a)/41 (1) of Bihar Prohibition & Excise Amendment Act.

As per prosecution case, total 152 liters country made liquor was recovered from a Tempo of which this petitioner is owner.

It is submitted by the learned counsel for the petitioner that his is innocent and has falsely been implicated in this case. Nothing has been recovered from possession of the petitioner.
