Petitioner seeks bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code. The FIR is against unknown. Petitioner has got four more criminal cases as antecedent. Petitioner is in custody since 06.09.2017. He was never put on TI Parade nor anything was recovered from possession of the petitioner. Only material against the petitioner is his confessional statement before the police and confessional statement of the co-accused Govind Mahto. One loaded gun has been recovered from the house of coaccused Bipin Mahto. Investigation of the case is already complete.
Considering the entire facts aforesaid, let the
Patna High Court Cr.Misc. No.37731 of 2018 (2) dt.10-07-2018 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Hathidah Police Station Case No. 52 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
