The petitioner seeks bail in connection with Palasi P.S. Case No. 268 of 2025 instituted for the offence under Sections 126(2), 115(2), 118(1), 109, 352, 303(2), 351(2), 351(3) & 3(5) of the Bharatiya Nyaya Sanhita, 2023. Subsequently, Section 103 of the BNS was added. 3.

The prosecution story, in brief, is that on 07.07.2025 at about 7:00 PM, while the informant and his family were returning from a Muharram fair, the accused persons attacked them with deadly weapons. Several family members, including the informant, his cousin and mother sustained serious injuries. The assailants also snatched a

It has been submitted on behalf of the petitioner that the petitioner is in custody since 10-07-2025. Petitioner bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. From perusal of the FIR, it would manifest that there is no specific allegation attributed to the petitioner, rather the same is general and omnibus in nature. Altogether, five persons have sustained injuries, but petitioner is not the author of any of the injuries sustained by the injured persons. Learned counsel next submits that parties are agnates. Charge sheet has already been submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, there being no specific allegation against the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing
