The petitioner seeks bail in connection with Madhepura P.S Case No.696 of 2016 registered for the offences punishable under Sections 341, 323, 353, 384, 419, 420, 504 and 506 of the Indian Penal Code.

Allegedly, the petitioner entered into the office of the Labour Enforcement Office, Madhepura and attempted to assault him and further created nuisance for one hour and thirty minutes and caused threats to kill him.

Submission is of false implication and that the petitioner is Labour Union Leader. The allegations against the petitioner are vague and omnibus in nature. The dispute between

No.37060 of 2018(2) dt.29-06-2018 2/2 the parties have been amicably settled, the informant and the petitioner have filed compromise petition to this effect vide Annexure- 2 and, as such, the petitioner suffering in custody since 09. 04. 2018 now deserves sympathetic consideration. Learned A.P.P. fairly submits that now the matter has been settled.

In the facts and circumstances stated above, the petitioner is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura, in connection with Madhepura P.S. Case No. 696 of 2017, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
