1. Heard learned counsel for the petitioner, learned APP for the State and the learned counsel appearing on behalf of the informant.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 191(2), 126(2), 115(2), 118(1), 109(1), 308(3), 303(2), 352, 351(2) of the B.N.S.
3. The learned counsel for the petitioner submits that the petitioner has antecedent of six cases, but then, all the cases have been instituted from the side of the informant as they are having land dispute. It is also submitted that grandfather of the petitioner and maternal grandfather of the informant were own brothers and thus, a land dispute is brewing in between the
Patna High Court CR. MISC. No.68862 of 2025(3) dt.31-10-2025 2/3 family members for which cases have been registered from both the sides.
4. The learned counsel for the petitioner submits that petitioner is a government servant and is not a criminal, merely because side of the informant has implicated him in six cases. It is also submitted that allegation against the petitioner is of assaulting the informant, but then, petitioner has been falsely implicated in the case only for the reason to coerce him and his family members into submission as petitioner is a government servant. It is also submitted that Navindra Jha @ Navin Jha had approached this Court seeking anticipatory bail by filing Cr. Misc. No.64065 of 2025 and the same came to be allowed by an order dated 11.09.2025. It is further submitted that process under Section 82 Cr.P.C. was issued against the petitioner, but then, the same has been stayed.
5. Learned A.P.P. as well as the learned counsel appearing on behalf of the informant opposes the anticipatory bail application.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on
Patna High Court CR. MISC. No.68862 of 2025(3) dt.31-10-2025 3/3 anticipatory bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Supaul in connection with Chhatapur P. S. Case No.279 of 2024, subject to the conditions laid down under Section 482(2) of the BNSS.
